In a significant ruling, the Gujarat High Court has refused to dismiss a molestation complaint against a grandfather accused of inappropriate behaviour towards his four-year-old granddaughter. The case highlights serious issues regarding child safety and the legal process in domestic disputes. The complaint was filed in 2019 by the father of the child at the Makarpura police station in Vadodara. He accused his wife and her parents of violating the Indian Penal Code (IPC) and the Protection of Children from Sexual Offences (POCSO) Act. The mother and grandmother of the child had previously sought to quash the complaint, arguing that the couple had reconciled after a separation. However, the court rejected this argument, stating that the reconciliation between the parents does not absolve the grandfather of his alleged crimes.
The court expressed surprise that the application to dismiss the complaint was made by the complainant’s father-in-law, rather than the accused. The allegations suggest that during a visit, the grandfather had inappropriately touched the four-year-old girl, and when her older brother protested, he was threatened. This led to the father filing a complaint against his wife, mother-in-law, and father-in-law.
The court noted that the girl was only four years old at the time of the incident and would now be nine. Despite the family’s reconciliation, the court maintained that the seriousness of the accusations should not be overlooked. The judge stressed that the child’s welfare must take precedence, and the legal proceedings cannot be dismissed simply due to family issues.
This ruling reinforces the importance of protecting children from abuse, regardless of familial relationships. It sends a strong message that legal responsibilities do not vanish with personal reconciliations, especially in cases involving the safety of minors.
