Surat Builder Ordered to Hand Over Flats by RERA

The Gujarat Real Estate Regulatory Authority (RERA) has issued a significant order to a builder in Surat. This decision comes in response to a complaint from a resident who had booked a flat in a residential project called ‘Jash Palace’ developed by the Samabhav Corporation. The project was launched in November 2017 but faced delays. The builder had promised to complete the project by November 2020, yet many issues arose during this time.

A worker of the corporation, who booked a flat worth ₹88.65 lakhs, faced challenges when the project was sold to new promoters. Initially, the worker paid ₹16 lakhs and was awaiting the rest of the amount to be settled upon the issuance of the sale document. However, the new promoters, led by Bhavin Kumar Shah, renamed the project to ‘Stellar Bliss’ and refused to issue the necessary documents to the worker.

The worker turned to RERA for help after the new promoters denied any obligation to honour the earlier agreement. They claimed that the allotment letter issued by the previous builders was invalid. However, the original builders acknowledged that the remaining ₹16 lakhs should be cleared by the new promoters before any further action could be taken. RERA’s ruling highlighted that the rights of the flats’ allottees must be protected, especially considering the builder’s failure to fulfil their commitments.

Furthermore, RERA noted that the new builders could not simply ignore the agreements made by their predecessors. The authority has instructed the new promoters to comply with the terms of the original agreement and to issue the required sale document upon receiving the outstanding payment. This decision serves as a reminder of the importance of transparency and accountability in real estate transactions.

In a separate incident, another builder in Ahmedabad, Nirav Zaveri, was arrested for fraudulent activities concerning land acquisition. Zaveri was accused of using false documents and tricking landowners into signing over their properties. The police have reported multiple complaints against him, indicating a broader issue within the real estate sector in Gujarat.

These cases underline the need for strict enforcement of real estate regulations in Gujarat. RERA’s involvement showcases its commitment to protecting the rights of homebuyers and ensuring that builders fulfil their contractual obligations. With the real estate market growing, it is essential for both builders and buyers to understand their rights and responsibilities to prevent such disputes.
