An important ruling has come from the Ahmedabad District Consumer Disputes Redressal Commission. The commission found that Star Health and Allied Insurance Company wrongfully rejected a claim made by a policyholder. This case highlights the rights of insurance policyholders and the need for transparent practices in the insurance industry.
Monaben Shah, a resident of Ellisbridge in Ahmedabad, bought a medical insurance policy in 2013. She renewed it every year. The policy had a sum insured of ₹10 lakh, with a deductible amount of ₹3 lakh. This meant she could claim up to ₹7 lakh for medical expenses.
In 2021, Monaben faced serious health issues related to her kidneys after treatment for COVID-19. The total cost for her treatment was ₹7,60,896. She submitted a claim to Star Health and Allied Insurance for the full amount.
However, the insurance company rejected her claim. They claimed that Monaben had a pre-existing medical condition, known as Sjögren’s syndrome, which they said was not disclosed when she purchased the policy. They argued that her claim exceeded the defined limit and thus could not be fully paid. Instead of the full claim, the company paid her only ₹3,39,439, which was significantly less than her total expenses.
Feeling that she had been treated unfairly, Monaben approached the consumer commission for help. The commission agreed with her. It stated that the insurance company cannot deny a policyholder’s right to their claim without valid reasons. The commission called the company’s actions an unfair trade practice.
As a result, the commission ordered Star Health and Allied Insurance to pay Monaben the rejected amount of ₹3,55,109 along with interest at 7%. Additionally, the commission awarded her ₹2,000 for legal costs and recognised the mental and physical distress caused by the insurance company’s actions.
This case serves as a reminder for all insurance companies. They must ensure their practices are fair and transparent. Policyholders have rights, and companies should not dismiss claims without proper justification. Monaben’s determination to seek justice not only helped her but could also encourage others facing similar issues to stand up for their rights.
The commission’s ruling reinforces the importance of consumer protection in the insurance sector. It also highlights the need for consumers to be vigilant about their rights and to seek help if they feel wronged. Monaben’s story is a testament to the power of perseverance in seeking justice against unfair practices.
